This Privacy Statement is issued on behalf of Mattel, Inc., and its affiliates and subsidiaries (including, but not solely, Fisher-Price, Inc., American Girl Brands, LLC, HIT Entertainment Limited, Mega Brands Inc. their affiliate and subsidiaries). For purposes of privacy and data protection laws, Mattel, Inc., is the ultimate data “controller” of your personal information, which means it is the entity that is responsible for deciding how your personal information is used and who gets to see it. When we mention “Mattel”, “we”, “us”, or “our”, we are talking about Mattel, Inc. In some cases, and depending on where you live, a local Mattel company will serve as the data controller for certain local processing activities. 2. WHAT IS PERSONAL INFORMATION?

When we say, "personal information," we're talking about any details that can be reasonably linked to you or otherwise used to identify you. This includes information you might share directly with us, like your name, phone number, or email when you create an account or make a purchase. It also includes information we might gather from your devices, like your computer or phone, when you visit our websites, apps, or social media pages. Personal information could also be things like your IP address or unique identifiers from your phone, which help us show you videos and content about our toys, movies, and games that we think you'll enjoy. When permitted by law, we may also use AI tools to generate insights or inferences about you (for example, likely preferences or demographic attributes) based on the personal information we already hold. When we refer to "processing," this means any operation performed on your personal information, such as collecting, using, storing, transferring (including cross-border transfers to other Mattel entities and third parties, as described in this Privacy Statement), disclosing, altering, or erasing your personal information.

We collect this information in various ways, either because you provide it directly to us, we automatically collect it when you use the Services, or sometimes we get the information with the help of other companies. Some of this information might be considered "sensitive” depending on the laws in your area (for example, a consumer may sign up for a newsletter based on pregnancy due date and we will use the information to customize the content they have requested).

You may have certain privacy rights, such as the right to ask us what information we collect about you, how we use it, to have access to it, or even delete it. • Opt Out of “Selling” or Sharing for Targeted Advertising (United States)
  You can go to Do Not Sell or Share My Personal Information in the footer of the website to ask us not to “sell” your personal information and not to share your personal information for targeted advertising purposes. Please note that to exercise the right to opt-out of the "sale" and "sharing" of personal information through cookies and online tracking technologies, you also have to opt-out out of both Functional/Performance/Analytics and Advertising cookies using the Cookie Preferences Tool, a link to which is available in the footer of Mattel websites that have non-essential trackers. Please note that the Cookie Preferences tool is browser and website specific, so you must reset your preferences if you clear cookies, visit a different Mattel-owned website, or use a different browser or advice.

• Opt Out of Marketing Communications from Us

4. OUR COLLECTION, USE, AND DISCLOSURE OF PERSONAL INFORMATION

We collect personal information in a variety of ways. For example, you may provide us with your personal information when you place an order, register for an account, make an online purchase, send us messages, subscribe to our mailing lists, newsletters, or other forms of marketing communications, or use some other feature of the Services.

We may link or combine your activities and information collected from you online with information we have collected from you offline, information we receive from third parties, as well as information we collect automatically through tracking technologies (as described below).

When you use the Services, we might also handle information that's been scrubbed clean of anything that could point back to you or your household (this is called anonymization). Once your personal information has been anonymized, we will treat this data as non-personal data and will keep it anonymized and will not try to figure out who it belongs to. The only time we'd look into it is to make sure we're following the rules about keeping information anonymous and to make sure that our anonymization process works.

We also use a technique called “pseudonymization” to help protect your privacy. This means we change or remove parts of the data that could identify you, but it still allows us or our partners to figure out who you are if really needed. 9. SPECIAL CATEGORIES OF PERSONAL INFORMATION (SENSITIVE DATA)

Mattel may collect and process certain types of personal information that are considered “special categories” or “sensitive” under applicable privacy and data protection laws. We use or disclose sensitive personal information for the purposes listed in the chart below. When such use or disclosure is necessary and proportionate for those purposes. These include performing services you have requested, for detecting security incidents, fraud and other illegal actions, to ensure the physical safety of natural persons, or for short term transient use. If we collect and process sensitive information about a consumer, we do not use it to infer characteristics about a consumer, and we do not sell sensitive information or process or otherwise share sensitive personal information for the purpose of targeted advertising. For Maryland residents (United States), the collection and/or processing of sensitive information is necessary to provide and/or maintain a specific product or services requested by you.

We implement appropriate technical and organizational measures to safeguard special categories of personal information against accidental or unlawful destruction, loss, alteration, unauthorized disclosure, or access. Where required by law, we will obtain your explicit consent before collecting or processing these types of data, and we will only use them for the purposes described at the time of collection or as otherwise permitted by law.

10. SECURITY OF PERSONAL INFORMATION

We implement appropriate technical and organizational measures to protect your personal information against unauthorized access, use, and accidental or unlawful destruction, loss, change or damage. These safeguards may include measures such as access controls, encryption, network monitoring, secure data storage, employee training, and regular testing of our systems. These measures also include automated monitoring tools powered by AI that help us detect and respond to suspicious activity in real time. We apply security practices that are proportionate to the sensitivity and amount of information and the potential risks of harm to individuals. We review and update these practices periodically to address evolving security threats.

11. INTERNATIONAL TRANSFERS

The personal information we collect may be transferred to and stored in countries outside of the jurisdiction you are in where we and our third-party service providers have operations, including in the United States. Wherever your personal information is transferred, stored or processed by us, we will take reasonable steps to safeguard the privacy of your personal information.

12. DATA RETENTION

Mattel will usually store the personal information we collect about you for no longer than necessary to fulfil the purposes for which it was collected, and in accordance with our legitimate business interests and applicable law. However, if necessary, we may retain personal information for longer periods of time, until set retention periods and deadlines expire, for instance where we are required to do so in accordance with legal, tax and accounting requirements set by a legislature, regulator, or other government authority.

To determine the appropriate duration of the retention of personal information, we consider the amount, nature and sensitivity of the personal information, the potential risk of harm from unauthorized use or disclosure of personal information and if we can attain our objectives by other means, as well as our legal, regulatory, tax, accounting and other applicable obligations.

Once retention of the personal information is no longer necessary for the purposes outlined above, we will either delete or anonymize the personal information or, if this is not possible (for example, because personal information has been stored in backup archives), then we will securely store the personal information and isolate it from further processing until deletion or anonymization is possible.

Services Offered to Children and Minors

Some of these services are designed specifically for children and/or minors, while others are intended for a general audience but may be accessed by users under 18. How Mattel Processes Children’s and Minors’ Personal Information

Brazilian Privacy Legislation. Mattel do Brasil sells its products through commercial partners, and we do not usually process consumers’ personal information during the sale. Mattel is a valid licensee and participating member in good standing of the ENTERTAINMENT SOFTWARE RATING BOARD’S PRIVACY CERTIFIED PROGRAM (“ESRB Privacy Certified”). ESRB Privacy Certified seals appear on the Services that participate in the program. The ESRB’S Privacy Certified Program is designed to ensure that our information disclosure practices are responsible and appropriate.

To help protect your privacy, we have voluntarily undertaken this privacy initiative and have had those Services associated with the ESRB Privacy Certified seal reviewed and certified by ESRB Privacy Certified to meet established online information collection, use, and disclosure practices. As a licensee of this privacy program, we are subject to audits of services and other enforcement and accountability mechanisms administered independently by the ESRB.

Before processing your request, we may need to verify your identity and confirm you are a resident of a state that offers the requested right(s). In order to verify your identity, we will generally either require the successful authentication of your account, or the matching of necessary information you provide us to the information we maintain about you in our systems. This process may require us to request additional personal information from you, including, but not limited to, your email address, phone number, and/or date of last transaction on the Services.

In certain circumstances, we may decline a request to exercise the rights described above, particularly where we are unable to verify your identity or locate your information in our systems. If we are unable to comply with all or a portion of your request, we will explain the reasons for declining to comply with the request.

Submitting Authorized Agent Requests

In certain circumstances, you are permitted to use an authorized agent to submit requests on your behalf through the designated methods set forth above where we can verify the authorized agent’s authority to act on your behalf. In order to verify the authorized agent’s authority, we generally require evidence of either (i) a valid power of attorney or (ii) a signed letter containing your name and contact information, the name and contact information of the authorized agent, and a statement of authorization for the request. Depending on the evidence provided and your state of residency, we may still need to separately reach out to you to confirm the authorized agent has permission to act on your behalf and to verify your identity in connection with the request.

Notice of Financial Incentives

We currently offer certain programs that provide benefits to consumers, and which may be considered financial incentives (the “Program”). These Programs allow members to earn personalized rewards and discounts. We may also provide discounts or promotions when you agree to receive marketing messages and communications from us or claim a specific offer when you interact with us and/or the Services (each, an “Offer”). The terms of each Offer will be provided to you when it is made available. You may opt out of marketing messages and communications from us at any time as described in our messages to you and as described in the “Your Privacy Choices” section of our Privacy Statement.

We collect and retain personal information to support and fulfill the Program and certain Offers, which may include information in the following categories: Identifiers, Commercial information, Internet or other electronic network activity information, Geolocation data, Inferences.

The personal information we collect and retain is also used to make or to supplement your account information (where applicable). The value of the personal information we collect will vary based on the Program or Offer and is calculated based on expenses related to offering the Program or Offer, which may include the costs associated with providing discounts or promotions, IP or marketing-related costs, and other related expenses.

You have the right to opt out of the Program and any Offer at any time in accordance with the terms of the Program or Offer or through the Mattel Privacy Choice Portal.

Shine the Light Disclosure
The California “Shine the Light” law gives residents of California the right under certain circumstances to request information from us regarding the manner in which we share certain categories of personal information (as defined in the Shine the Light law) with third parties for their direct marketing purposes.
